i. This website is owned and operated by Easter Egg Warehouse Pty Ltd ABN 95 147 912 230
ii. By accessing, browsing or using this website, you agree to all terms, conditions and disclaimers.
iii. The Easter Warehouse Pty Ltd trades as The Easter Egg Warehouse.
iv. The Easter Egg Warehouse may amend these terms and conditions from time to time. Any amendment is effective immediately.
i. We have a number of convenient delivery options for you to choose from.
ii. These include the following:
1. Fastway Couriers (Australian Deliveries Only)
2. Pick-up at Warehouse by You
3. Pick-up at Warehouse by Your Courier
Delivery options are for orders via our website only
i. Fastway Couriers is our safe and secure trusted delivery service throughout Australia. They provide the Easter Egg Warehouse with full tracking and insurance on your delivery
ii. All our chocolate items are delivered in a safe cardboard box. We also provide the option for further insulation when packaging your order.
iii. To receive a quote for shipping your Easter items, please type in your shipping postcode into the delivery calculator and you will receive your quote.
iv. We do not deliver on Saturday, Sunday and Public holidays. Fastway Couriers do not deliver to PO Boxes.
v. In some instances we may not be able to deliver to your area.
vi. For any further questions about delivery please feel free to contact customer service on 1300 784 995.
Pick Up At Store by You
i. Pickup your order from The Easter Egg Warehouse during our opening hours. Click here for location and opening hours.
ii. No Shipping or Handling Charges.
iii. Once your order is ready, we will contact you to let you know that it is ready to be picked up.
iv. Allow at least 2 working days and call us before coming to our warehouse if we haven’t called you to advise that your order is ready.
v. You will be required to sign to confirm you have picked up your parcel.
vi. You must bring photo ID with you and you must be the person named on the order or the person advised as the party picking up the order in the order comments.
Pick Up At Store by Your Courier
i. Send your own courier to pickup your order from the Easter Egg Warehouse during trading hours.
ii. No Shipping or Handling Charges.
iii. Allow at least 2 working days and call us before sending your courier.
iv. DO NOT send your courier before we call you to confirm your order is ready.
v. Once your order is ready, we will contact you to let you know that it is ready to be picked up.
vi. Notify us of the courier company that will be picking up your order to enable us to find the parcel for your courier in a timely manner.
vii. Your courier will be required to sign to confirm they have received your parcel.
viii. We are not responsible for courier costs, courier delivery times, courier handling or miss handling.
ix. We do not accept any responsibility for damaged items inside parcels delivered to you by your courier. The courier must ensure the contents are as required when receiving the goods.
What Happens If I Am Not Home When My Order Is Delivered?
i. If a delivery is made when you are not home, the courier driver will leave a calling card with their phone number to organise a return date with you.
ii. If you are not available on the return date your parcel will be taken to your nearest Fastway Depot (Locations available on the Fastway Couriers Website).
iii. If within 7 days you have not picked up your parcel, the carrier may return the goods to The Easter Egg Warehouse with no refund available.
iv. If the goods are spoiled during this process it will be responsibility of the customer.
What happens if my Order is lost?
All our delivery options are provided by a third party and it is rare that a courier company or Australia post lose a parcel. As delivery is provided by a third party for your convenience, we cannot accept responsibility for a lost parcel.
3. PASSING OF RISK
Risk of loss or damage to goods from whatever cause arising shall pass from the Company to the purchaser immediately upon delivery by the Company into the hands of the carrier.
4. CUSTOMER OBLIGATIONS
i. Customers must supply The Easter Egg Warehouse with a valid email address and at least one phone number. Either a landline or a mobile number.
ii. The Easter Warehouse accepts no liability arising out of failure to contact a customer, where the contact details were not supplied, were invalid or incorrect.
i. It is the obligation of the customer to ensure the recipient’s delivery address is correct. Please note Fastway Couriers do not deliver to PO Boxes.
ii. Failure to provide the correct delivery details may result in incorrectly delivered goods, undelivered goods and additional redirection fees.
iii. The Easter Egg Warehouse accepts no liability for incorrectly delivered or undelivered goods, where the customer made no reasonable attempt to correct the address within a reasonable period of time and/or The Easter Egg Warehouse acted reasonably when delivering the goods.
Recipient Details and Personalised Messages
i. The customer must ensure recipient details, such as their name and address are correct and also spelt correctly. The Easter Egg Warehouse accepts no responsibility for any incorrect information, when such information results from a reliance on information provided by the customer.
ii. In regards to internet orders, customers should ensure that their personalised message is written to their satisfaction. The Easter Egg Warehouse accepts no responsibility for incorrect spelling, grammar or formatting.
5. ALTERATIONS AND AMENDMENTS TO ORDERS
I. We are unable to provide any alterations or amendments (including cancellations) for orders that are in the process of being prepared, already prepared and/or in transit. This could be up to 7 business days in advance of delivery date.
II. No cash or credit refunds will be made for alterations or amendments that result in a value less than the original order cost.
III. The Easter Egg Warehouse reserves the right to refuse alterations and amendments.
6. CANCELLATION OF ORDERS
I. Cancellation requests received at a minimum of 72 hours prior to the scheduled delivery date for deliveries within Australia will incur an administration fee of $20.00.
II. Please contact our Customer Service on 1300 784 995.
III. Cancellations received after the applicable period stated above, are void.
IV. If the cancellation is authorised the difference will be refunded, within 5 – 7 working days, or at the discretion of the customer’s bank/financial institution.
V. The Easter Warehouse is unable to cancel orders that are already prepared and/or are with a courier for delivery.
7. COMPLAINT POLICIES
I. Any dissatisfaction with the product(s) must be communicated to Customer Service in writing within 24 hours of delivery. Please direct all complaints to email@example.com.
II. The Easter Egg Warehouse reserves the right to request photos of the original product(s). To assist us in quality control it is our policy, if requested by us, to collect the original products.
III. In the event that there are damaged goods in the delivery, please contact Customer Service immediately on 1300 784 995
IV. The Easter Egg Warehouse reserves the right to request a photo of the damaged goods and/or a return of the hamper/damaged goods to a reply paid address.
8. PRODUCT RANGE
i. Products in the Easter Egg Warehouse range are not available for delivery to all locations. Customers will be informed when a selected product is not available in the delivery location.
ii. At any given period, The Easter Egg Warehouse may sell out of a particular product range and or product. This will mean that we may not be able to supply that particular product.
i. The Easter Egg Warehouse endeavours to fulfil all orders, however orders may be subject to product unavailability due to supply and demand.
ii. In the event that your order cannot be fulfilled, we will contact you to discuss substitution of your selected product for a similar product.
9. PRICING AND TRANSACTIONS
i. All prices quoted, unless otherwise stated, are inclusive of GST.
ii. All prices, unless otherwise stated, are quoted in Australian dollars (AUD).
iii. Product prices do not include delivery fees.
iv. In the event a customer is entitled to a refund, the refund will be made to the original credit card.
10. SECURITY AND PRIVACY
Collection and Use of Information
i. The Easter Egg Warehouse collects personal data for the purpose of fulfilling orders for products, or for the purpose of competitions and prize-giving, or for any other such purpose which requires the collection of personal data in order for The Easter Egg Warehouse to fulfil an obligation.
ii. Personal data includes, but is not limited to: the full name of the customer and/or recipient or competition entrant, payment details, e-mail address, recipient address and contact (mobile) phone numbers.
iii. The Easter Egg Warehouse does not keep records of customer credit card details.
iv. For customer security, your IP address has been logged and will be recorded with your purchase details.
v. We employ reasonable security measures to protect the security of the information you submit to us. Our servers protect this information using password protection and advanced encryption, and we may use firewall technology for additional protection.
vi. In order to most efficiently serve you, credit card transactions are handled by established third-party banking institutions. They receive the information they need to verify and authorise your credit card transactions to help us ship out your order. When collecting credit card information for online purchases, we offer secured server transactions that encrypt your information in transit to thwart someone from intercepting it and misusing it.
vii. When you access your account information, the information is kept on a secure server. Furthermore, all of the customer data we collect is protected against unauthorised access by physical security means.
Disclosure of Information
i. The Easter Egg Warehouse may disclose personal data necessary to third party service providers for the purpose of fulfilling customer orders and any other obligations, such as prize-giving or sponsorships.
ii. The Easter Egg Warehouse will not disclose personal information to third parties for marketing purposes without prior authorisation.
iii. Under no circumstances will The Easter Egg Warehouse sell or receive payments or services for disclosing customer’s personal information to any partner or external company.
iv. Except as otherwise stated in this Policy, we do not sell, trade or rent your Personally Identifiable Information collected on our website to others. You expressly consent to the sharing of your Personally Identifiable Information with third-parties as described below.
Sender Anonymity and Disclosure
i. Customers have the right to remain anonymous except in circumstances where personal information is required to complete an electronic transaction.
ii. The Easter Egg Warehouse will not disclose sender/customer information to a recipient unless requested or approved to do so by the sender/customer.
i. The Easter Warehouse websites utilise cookies to store information of browsing history and to enable browsing features. We do not store any personal or financial information about customer-used cookies.
i. Customers can elect to receive promotional material by joining as a Member and or entering a competition opting to receive plain text or HTML emails.
ii. In compliance with Australian law, all marketing material sent to the subscriber will include an option for the subscriber to request removal from mailing or contact lists for any future marketing
i. Any party engaged in illegal activities involving the use of The Easter Egg Warehouse website will be subject to civil and criminal sanctions and prosecution.
ii. The Easter Warehouse does not guarantee that it will be able to prevent any illegal or inappropriate use of its website, nor that it will give notice of any illegal or inappropriate use of its website.
iii. It is illegal to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. Persons found to have placed a fraudulent order will be prosecuted.
12. GOVERNING LAW
i. The use of this website and these conditions is governed by and construed in accordance with the laws of Australia.
ii. Any legal action arising out of its use shall be brought and enforced under the applicable Australian law.
iii. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.
13. THIRD PARTY SITES
i. Websites operated by The Easter Egg Warehouse may provide links to related third party sites. The Easter Egg Warehouse is not responsible for the privacy practices or the content of such websites and does not warrant the security of any information supplied to third party sites.
14. TRADEMARKS, COPYRIGHTS AND RESTRICTIONS
ii. All material on websites owned, operated, licensed or controlled by The Easter Egg Warehouse, including but not limited to images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by The Easter Warehouse its related companies or by other parties that have licensed their material to The Easter Warehouse.
iii. Material on any website owned, operated, licensed or controlled by The Easter Warehouse is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of The Easter Warehouse.
iv. Use of the materials on any other website or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of The Easter Egg Warehouse copyrights, trademarks and proprietary rights and is prohibited.
15. FORCE MAJEURE
i. The Easter Egg Warehouse is not liable for failure to perform obligations, including but not limited to, the fulfilment of an order or a delivery, if such failure occurs as a result of acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster) war, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power, terrorist activities, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service or any other event or phenomenon beyond The Easter Egg Warehouse’s control.
